Privacy Policy
We collect as little as we can to run the letter, we do not sell your data, and you can leave with one click. Here is exactly what we hold and why.
1Who is responsible
The Probative, operated from 1610 Rue Sanguinet, Montréal, QC, Canada, is responsible for the personal information described here. Contact us any time at hello@theprobative.com.
2What we collect
- Email address — when you subscribe to the free letter or become a Member.
- Payment information — handled entirely by Stripe. We never see or store your full card number; we receive only a customer ID, plan, status, and billing email.
- Account & sign-in data— your email and single-use sign-in tokens / session records, so you can access the members’ portal without a password.
- Usage data — basic, largely aggregate information such as which pages or links were opened and email open/click events, used to operate and improve the letter.
3Why we use it (and our legal basis)
We use your information to deliver the letter and operate the portal, process payments and honour subscriptions, send the emails you asked for and essential account notices, prevent abuse, and meet legal obligations. We rely on performing our contract with you, your consent (for marketing email, which you may withdraw at any time), and our legitimate interest in running and securing the service. We do not sell, rent, or trade your personal information.
4Who we share it with
Only the processors we need to run the service, each bound to protect your data:
- Stripe — payment processing and subscription billing.
- Resend — transactional and issue email delivery.
- Beehiiv — free-list email management.
- Cloudflare — hosting, the members’ database, and content delivery.
5Email and opting out
Every email includes an unsubscribe link, and you can also unsubscribe by emailing hello@theprobative.com. We honour opt-outs promptly. Consistent with Canada’s anti-spam law (CASL), we send commercial email only with your consent and always identify ourselves with a valid postal address.
6Cookies and sessions
We use a small number of strictly necessary cookies — chiefly a secure, signed session cookie that keeps you logged in. We do not use third-party advertising or cross-site tracking cookies.
7How long we keep it
We keep your information for as long as your account is active and as needed to provide the service, then for a reasonable period to meet legal, tax, and accounting obligations, after which it is deleted or anonymized.
8Your rights
Depending on where you live (including under Canada’s PIPEDA, the EU/UK GDPR, and US state laws), you may have the right to access, correct, delete, or port your information, to withdraw consent, and to object to certain processing. To exercise any of these, email hello@theprobative.com and we will respond within the time the law allows. You may also complain to your local data-protection authority.
9Security and international transfers
We use reasonable technical and organizational safeguards, including encryption in transit and password-less sign-in. No method is perfectly secure. Our processors may store or process data in the United States and elsewhere; where required, appropriate transfer protections apply.
10Changes
We may update this policy; the “last updated” date will change and material updates may be emailed to members. Continued use means you accept the updated policy.
